By accessing or using LendPresence, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, you must not use our platform.

2. Description of Service

LendPresence provides a SaaS platform that enables Loan Officers to:

• Aggregate and tailor mortgage-related news.
• Create, schedule, and automate social media posts.
• Monitor engagement analytics on supported platforms (such as Facebook, LinkedIn, and Instagram).

Our services are intended solely for professional use by licensed Loan Officers and similar professionals in the United States.

3. Account Registration

To use LendPresence, you must:

• Provide accurate, complete, and current registration information.
• Maintain the security of your password and login credentials.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activity conducted through your account.

4. Use of the Platform

• Only for lawful purposes and in compliance with all applicable laws, regulations, and industry guidelines (including NMLS requirements and social media platform policies).
• Not to engage in any activity that could damage, disable, overburden, or impair the platform.

We reserve the right to suspend or terminate your access if you misuse the service.

5. Social Media Integrations

• You authorize LendPresence to post content on your behalf as scheduled by you.
• You retain full ownership of your social media accounts and content.
• You may revoke access at any time through your social media account settings.

We are not responsible for any changes in third-party platform rules or limitations.

6. Subscription Plans and Payments

• Pay-As-You-Go Plan: $5 per post.
• Monthly Budget Plan: $20/month for 5 posts + $5 per additional post.
• Premium Plan: $99/month for unlimited posts + full analytics access.

Billing is handled via a secure third-party provider.
You are responsible for all charges associated with your account.
We reserve the right to change pricing with advance notice.

7. Cancellation and Refunds

You may cancel your subscription at any time.
No refunds will be provided for partial months or unused posts unless otherwise required by law.
Upon cancellation, your access to LendPresence will remain active through the end of the billing period.

8. Intellectual Property

All content, logos, trademarks, and software associated with LendPresence are the property of LendPresence, LLC or its licensors.
You are granted a limited, non-exclusive, non-transferable license to use the platform solely in accordance with these Terms.

9. Disclaimer of Warranties

LendPresence is provided on an "as-is" and "as-available" basis.
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free service.

10. Limitation of Liability

• LendPresence shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the total amount paid by you to us during the twelve (12) months preceding the claim.

11. Indemnification

• Your use of the platform.
• Your violation of these Terms.
• Your violation of any third-party rights.

You agree to indemnify and hold harmless LendPresence, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from the above.

12. Changes to Terms

We may update these Terms of Service from time to time.
Significant changes will be communicated via email or your dashboard.
Your continued use of LendPresence after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
Any disputes will be resolved exclusively in the state or federal courts located in [Lee County/FLORIDA].
